    actually yeah...

R Kelly (for his last record I think), sampled a local Toronto artist called Pavlo or Pablo (proper name escapes me at the moment). The thing is, this dude is a flamenco guitarist, the kind of guy you see playing along with his own CD at home shows and things like that. So R samples something off this cats CD (how he got it I don't know...maybe at a home show buying a new leather sofa??), and of course doesn't clear it as it's just some small guitar licks and so on.However, Pablo/Pavlo is a pretty sussed dude as he has been making records for a few years, and while listening to the radio in his car one day, hears R's new ish and realises "shit...that's my music". Rest of the story goes that Pavlo/Pablo has a lawyer contact the labels, and long story short, got a quick $200,000 thou to settle out of court. Pavlo/Pablo then apparently bought his parents house out, and bought himself a down payment on a Condo. This was all reported in a major Canadian newspaper and all over radio news.

    True story my friends...

considering it wasn't cleared in the first place, and it was r kelly, and it was a single (he heard it on the radio right?)... pablo could have prolly came up with much more $$.

Didn't Fatboy Slim sample the Freedom Now Brothers "Sissy Walk" 45 without clearance?

  • i remember hearing a radio show with the guitarist saying how each note equalled a six figure dollar cheque essentially. to my knowledge, kelly sampled 4 notes. cotdayum.

just to be sure, i'm not the only one who's seen the above lady in porn, right?

  • jimmy jam and terry lewis sampled LA Carnival and were made to pay... the main reason ST profited from that reissue

a professor I had for a music business class represented the prosecutors in this case. apparently Quik was watching some international cienema channel, taped it with his VCR and just sampled it off that and gave no thought to it. not a wise move. the way he talked about it in class (this was before they had gone to trial) it seemed like Quik was going to get fucked. then he rambled about the grey album for like an hour.
