Got this note from E-bay before re-listing an item:


CROSS BORDER TRADE AGREEMENT

You are attempting to list an item(s) on eBay???s United States site, eBay.com (the ???U.S. eBay site???), the terms of which are with eBay Inc. (???eBay???). You must review and accept this Cross Border Trade Agreement (the ???Agreement???) before you will be allowed to list on the U.S. eBay site.

PARTIES. If you have a PayPal account, this Agreement is between:

?? You;
eBay; and,

?? PayPal ??? if you have a PayPal account registered in the European Union, PayPal (Europe) S.??.r.l. & Cie, S.C.A., and if you have a PayPal account registered outside the European Union, the PayPal entity with which you have entered into a User Agreement to receive the PayPal Services (such PayPal entity ???PayPal???).

If you do not have a PayPal account, then this Agreement is between you and eBay only.


APPLICATION TO ALL CURRENT & FUTURE LISTINGS. This Agreement will apply to all of your active or ???live??? listings that you have posted to the U.S. eBay site, including Good ???Til Cancelled listings, as well as any future listings that you post on the U.S. eBay site. If at any time after accepting this Agreement you no longer want these terms and conditions to apply to future listings on the U.S. eBay site, then all you have to do is not list additional items on the U.S. eBay site. Also, if at any time after accepting this Agreement you no longer want these terms and conditions to apply to your already active or ???live??? listings on the U.S. eBay site, then you must end your listings in accordance with eBay.com???s policy for ending listings.


PAYMENT HOLD NOTICE: PAYPAL FUNDS FROM YOUR U.S. EBAY SITE SALES MAY BE UNAVAILABLE FOR A PERIOD OF TIME. If and when you are paid through PayPal for items you list and sell on the U.S. eBay site, you understand, acknowledge and agree (and accept this paragraph as PayPal???s notice) that for such transactions:

a) If PayPal believes that there is a risk associated with you, your PayPal account, or any or all of your PayPal transactions, then pursuant to the ???Payment Hold??? section of your PayPal User Agreement, PayPal may hold the funds you receive into your PayPal account from each of your transactions on the U.S. eBay site for up to 21 days from the date on which PayPal lets you know that it is ???OK to Ship??? the relevant item, or in some instances longer. You may view the text of the ???Payment Hold??? section that applies to PayPal accounts registered in the European Union here.

b) PayPal will consider a number of factors in evaluating if there is a risk, such as if eBay considers you to be a seller who does not meet certain seller standards, or you are a new PayPal customer and/or eBay seller or have a limited customer/seller history with PayPal and/or eBay. You may review additional information about the circumstances under which payments will not be immediately available for items you sell on the U.S. eBay site here.

c) If you use a PayPal account registered in a country outside of the European Union, you agree that the PayPal entity that operates the PayPal website where you registered your PayPal account, in its sole discretion, may place a hold on any or all of the payments you receive when it believes there may be a high level of risk associated with you, your account, or any or all of your transactions; that its determination may be based on a number of different factors and may rely on information it receives from its third party partners, such as eBay; that, if it places a hold on a payment, the payment will show as "pending" in your account; that, if it places a hold on any or all of the payments you receive, it will provide you with notice of this action; that it will release the hold on any payment after 21 days from the date the payment was received into your account, unless you receive a dispute, claim, chargeback, or reversal or it takes another action permitted under its user agreement with you; that it may, in its sole discretion, release the hold earlier under certain circumstances, for example, if you have uploaded tracking information; and that it may continue holding the payment in your account if you receive a dispute, claim, chargeback, or reversal, until the matter is resolved pursuant to its user agreement with you.



EBAY BUYER PROTECTION POLICY. You acknowledge and agree that the U.S. eBay site has an eBay Buyer Protection Policy (the ???eBay Buyer Protection Policy???). Among other terms and conditions, if a dispute arises and cannot be resolved between you as a seller and your buyer on the U.S. eBay site, you agree that eBay will resolve the buyer???s complaint pursuant to the eBay Buyer Protection Policy. This includes being liable to eBay for any and all amounts refunded to your buyer under the eBay Buyer Protection Policy. The full terms of the eBay Buyer Protection Policy may differ from the eBay buyer protection policy (if any) that governs your own eBay site of registration.



LISTING FEE REFUNDS. If an eBay Buyer Protection Policy dispute is resolved in favor of your buyer and your buyer receives a payment under the eBay Buyer Protection Policy, you will not receive a refund of your listing fees from eBay.



BILLING AGREEMENT. If you have a PayPal account and use it to list and sell on the U.S. eBay site, you agree to the following:

a) AUTHORISATION TO CHARGE YOUR PAYPAL ACCOUNT

You hereby authorise eBay, or any eBay affiliate appointed by eBay, to charge your PayPal account for the full amount of any money you owe eBay under the eBay Buyer Protection Policy (the ???Authorised Amounts???) on a one-time, sporadic, or recurring basis.



b) YOUR INSTRUCTION TO PAYPAL

You authorise and instruct PayPal, or any PayPal affiliate, to debit your PayPal account for all and any Authorised Amounts and to pay eBay, or any eBay affiliate appointed by eBay, such Authorised Amounts. By providing such authorisation and instruction, you acknowledge and agree that in all circumstances you reasonably expect that payments made pursuant to this section are variable and may be made on various dates.



You further agree that PayPal is not obliged to verify or confirm the amount that eBay presents to PayPal for the purpose of processing the payment of any Authorised Amount.



c) CANCELLATION

(i) If at any time you no longer want PayPal to debit your PayPal account for future Authorised Amounts, then all you have to do is not list additional items on the U.S. eBay site and end all and any of your active or ???live??? listings on the U.S. eBay site in accordance with eBay.com???s policy for ending listings. Alternatively, for listings not yet active or ???live??? on the U.S. eBay site, you may withdraw this authorisation by emailing PayPalReimbursementOpt-Out@ebay.com, using your registered eBay email address, providing your eBay ID, and stating your intention to Opt-out of PayPal reimbursement. Your withdrawal will be effective within one business day, after which time eBay will not use your PayPal account to recover amounts that you owe due to a U.S. eBay site claim. However, as a consequence of withdrawing this authorisation, you will no longer be allowed to list on the U.S. eBay site.

(ii) If you use a PayPal account that is registered in the European Union, this section is without prejudice to your right to cancel a recurring payment pursuant to the ???Cancelling Recurring Payments??? section of the PayPal User Agreement. You will remain obligated to pay eBay for all unpaid amounts, and eBay reserves the right to seek reimbursement through other means.



AUTOMATIC PAYMENT METHOD. eBay may require you to have an automatic payment method on file with your eBay site of registration. Where there are insufficient funds in your PayPal account balance and where you have designated PayPal or another payment method as your automatic payment method on your eBay site of registration, you authorise eBay, or any eBay affiliate appointed by eBay, to charge your automatic payment method (and, if PayPal is your automatic payment method, any payment methods or funding sources linked to your PayPal account) for all and any amounts eBay paid to your buyer for claims resolved against you under an eBay Buyer Protection policy, subject to the terms of the billing agreement governing the use of your automatic payment method. If eBay, or any eBay affiliate appointed by eBay, is unable to charge your automatic payment method, you agree to reimburse eBay in full and in a timely manner for all and any amounts eBay paid to your buyer for claims resolved against you under an eBay Buyer Protection policy, subject to account sanctions, up to and including account suspension and termination, for failure to reimburse eBay.



AMENDMENT. With the exception of subsections (a), (b), and (c)(ii) in the above ???Billing Agreement??? section, eBay and/or PayPal may amend these terms at any time by posting the amended terms in accordance with the relevant eBay and/or PayPal User Agreements. All amended terms will automatically be effective 30 days after they are initially posted. Additionally, eBay will notify you via the Messages section of My eBay.



MISCELLANEOUS. The laws applicable to this Agreement shall be the laws of the State of California. To the extent that there is any conflict between the terms of this Agreement and the User Agreement for the eBay site with which you are registered, including, where applicable, the eBay Buyer Protection policy for the eBay site with which you are registered, these terms shall prevail. If you accept this Agreement, a copy of the Agreement will be sent to the email account on file with your eBay site of registration as well as the Messages section of My eBay, where you may print a copy of this Agreement for your records.

They make it impossible for us, European sellers (Euroman) (or other outside US sellers), to do some proper business
from now on.

    Its been like that for a while now , you have to list in the country's ebay where you live , in your own currency, all you have to do for it to be seen on worldwide ebay (without them actually searching worldwide) is tick the box, show worldwide (extra) on the last preview page before listing

  • On our eBay site (EBay.nl) it only gives an option in the last field to also list on EBay.uk for an extra 0,50 for each month (eBay store).
    Too bad it will make this even more difficult for us trying to sell our nice euro- goodies to US customers.
    We allready moved on & started working on Discogs.
    We took off more than 2000 items from our EBay store because EBay decided we have to pay 0,20 per item each month instead of the 0,05 we paid for years.
