I honestly thought this was going to be one of those "OK, so a friend of a friend wants to rob someone - one who REALLY deserves it..." threads

this is kind of directed towards Harvey & Bassie, but is really open to anyone:

i totally agree that going to the cops with this is problematic, complicated and a ways from ideal, for reasons y'all have already mentioned.

but i also think Harvey's solution of going to the kids' guardians or neighborhood authority figures isn't going to be a realistic option in a lot of cases. maybe you don't know these figures, maybe they don't exist, aren't reliable, don't trust you/respect you enough to help, etc. etc.

my question is: is there a 3rd option at all? i.e. if they're not in a position to deal with it by going to the guardians, are they stuck with dropping it or going to the cops?

Kick the toy gun out of kid's hand. If you are an adult male and haven't trained yourself to fight more than one person kid at a time, even if one is armed...then start training now.

Our lives really aren't that valuable...fuck it, sometimes you just gotta DEAL!

Pretty sure that was meant as a joke, but regardless, I have trained in full contact self defense for a little over 16 years, am a 2nd degree black belt (and ex instructor) in karate/jiu jitsu/judo have done around 8 years of thai boxing/boxing, i have also done quite a bit of training in Arnis/Kali/Dos Pares (short weapon specialist) and am currently training in Bujinkan, so I would consider myself proficient in self defense, and my advice is to do the opposite of what he said esp if there is an armed or multiple opponents, be cool, defend yourself if you absolutely positively have no other option/way of running away, other than that be as non threatening as possible, comply to all demands and call the cops if needed when its over. i mean no offense when i say this, but if you have allowed yourself to get into a situation where some one has robbed you then street level revenge probably isn't in you. as for the BB gun thing, always treat any threat of a weapon on a worse case scenario, meaning unless the gun has an obvious big red plug (toy gun) always assume that it is a live weapon with live rounds, same thing goes with any blade.

Just got off the phone with the DA. turns out all four were caught, and confessed to mine and 3 other assaults that night. Two are adults but will be let go with probation most likely as they have no priors. The other two (one being the gunman) are juvys with no other records and will likely get off pretty light as well. DA made it sound like dumb kids trying to get their jollies after this prom party thing they were all at.

I don't think throwing people like this in jail will make them come out any better, but its strange thinking these dudes are gonna be roaming the streets agian in a matter of weeks or months.

Also, this wasn't a garden variety hold up either. They didn't approach me, ask for my shit and run off. It was real aggressive style. They pretty much ran up on me, went through all my pockets, knocked me to the ground and kicked me around for a minute so...

I'm glad that their behavior has been documented. I think it's good to report these types of crimes in order to detect patterns in behavior.
I think the advice in this thread would have been much different if the original poster was a female who was robbed in a similar fashion.

I was once in a domestic disturbance situation in which an angry ex snatched my purse (wallet, cell phone, keys) from me. I started chasing after him and ended up in his car trying to get my shit back (I guess I choose fight over flight...), but he was just too strong. He started driving and I started freaking out bc I didn't know where he was going to take me and he was threatening strange things. He eventually stopped the car in order to call the cops on me[/b] while I took my stuff back and got out of the car. I called a roommate to get me. She urged me to report it. I did, and the local police actually took my story down first, even though I was not the first to call in, as they could see that I was actually the victim in the situation. This guy has his screws on loose, but at least it will have been documented on paper if/when some other person feels threated by him.

Thank you for making sense. I've been LMFAO at Harvey's 'real world' street tough talk that is so out of touch with reality it's mind-boggling. I'm still trying to figure out what movie he lives in.

I would also point out that a kid with a gun is ten, if not a hundred times more likely to shoot you than an adult/experienced criminal. Attempting to kick it out of their hand has got to be one of the top three stupidest street moves imaginable. You'll most likely end both of your lives in one dumbass bit of bravado.

Next he'll be recommending you say 'go ahead, if you're so tough, shoot me!"

I've been in a similar situation and what I wanted to ask here is if the threat of taking it to court, meaning that they get to know who you are, where you live etc. through their defense attorney is in reality outweighed by the fact you got out of this situation alive? After all, how big is the HOOD and how big is the probability to run in them again or them threatening you again /bw breaking into your house? It's an effed up world we're living in and you can only be so street smart...and again, as was pointed out in this thread, if you talk to pro's in this field, the best advice is to always RUN while you can...thus, the best defense tactic is to train athletics imo...

Doubtful. But for real, people complain about him yet insist in responding to him. You can't have it both ways.

    this...

the idea that anyone approached by 3 people w/ a weapon should be able to

    a) determine the validity of the weapon (in the dark)
    b) be able to fend off 3 teenagers

    is crazy

and harvey, for someone who was on here acting like the world was ending when you broke up w/ yr girl, yr attitude is suprising... breakups are some universal pain between 2 people, we've all been there, and it sucks... but, to have so little compassion for someone who has the victim of a violent crime is totally fucked when u were on here asking for compassion in a situation where no one physically hurt u and noone punked u.....

and button, yes, you should go fwd... the judge aint throwing the book at these kids... at worst, they go to boot camp and if they are running around w/ 2 of their boys pulling weapons on people and beating on them, they need SOMEONE to put them right...

  • As a criminal defense investigator I work on cases like this all the time. The truth of the matter is that if you don't step forward and press charges, they're just going to keep doing shit like this over and over again. By going to court you'll be putting something down on the record, and therefore the next time they pull something like and get caught the consequences will be more severe. The fact that a bee bee gun was used does nothing to diminish the fact that they threatened your life. And the fact that they punched/kicked you shows that they meant business and weren't just playing around. In my 8 years of doing this I haven't heard of very many cases of retaliation for robberies of random civilians, but I'm not going to say that the risk isn't there, some people are just crazy. I'm betting that these kids knew that what they were doing was stupid, so it's doubtful that they feel self righteous about the whole thing. Also, I think you said that they admitted to a couple of other armed robberies. Chances are they'll cop a plea and this will never even go to court, ie. you won't have to testify. I say go ahead and ID them. These kids need to learn that their actions have consequences.

  • But I am curious- what property of yours were they caught with? Did they take your whole wallet, or was any of the stuff obviously yours?

After you fight off some local teens who try to rob you you'll feel tense and will need to blow off some steam. The best way to relieve that tension is to smoke a lot of weed and take your kids to the local swimming hole.

New York Penal Law ? 160.10 Robbery in the second degree.
A person is guilty of robbery in the second degree when he forcibly
    steals property and when:
    1. He is aided by another person actually present; or
    2. In the course of the commission of the crime or of immediate flight
therefrom, he or another participant in the crime:
    (a) Causes physical injury to any person who is not a participant in
    the crime; or
    (b) Displays what appears to be[/b] a pistol, revolver, rifle, shotgun,
machine gun or other firearm; or
    3. The property consists of a motor vehicle, as defined in section one
hundred twenty-five of the vehicle and traffic law.
Robbery in the second degree is a class C felony.

Class C felony for a juvenile = sentence of no more than seven years. Not that they will ever serve seven years, but it's no joke.

    * In fact, you don't even need (2)(b) because they satisfy (1).

They don't need 7 years in jail. More inventive justice is required here.

It sounded like, because they confessed everything, that it probably wouldn't go to a trial. But that option is by no means off the table. Did you end up having to testify or anything?

The shitty part about this is that they got me 2 blocks from my house, in a pretty specific part of town. I'm the kind who is/was always walking or biking around so if they hung around my area they would probably spot me pretty quick. The DA was all "they don't live anywhere near you", and I said it seems like they found their way over just fine this weekend. Then he told me what area specifically they live in and its like 10 minutes away by car.

But I am curious- what property of yours were they caught with? Did they take your whole wallet, or was any of the stuff obviously yours?

One of them had my cell phone and my money. Another got caught with the gun. I didn't have my wallet on me at the time.

Really I think these dudes just need some proper guidance from somewhere. Putting them in jail with a bunch of career criminals in a way almost seems like the dumbest idea on the table. Is that wrong to think?

dude, you got got, it happens (except Jean-Claude van Harv), shit it was damn near a right of passage when i was growing up.

Not at all. It would take bad to worse.
But a walk with no follow-up is hardly the answer either.

I really hope something good comes out of this.

I told dude I'm sorry to hear what happened to him...and I meant it.

But any unfortunate situation can and should be reevaluated in retrospect, even my marriage...although I guess I'm now having regrets feeding you famished-for-drama beasts with any ammunition from my personal life.

    I can DEAL though...whatever.

But I will say that our generation is by far the wimpiest in the history of the world. Our parents and their parents and their parents fought in wars where they were giving up their lives, in some cases for seemingly nothing, before they were even reaching the age of 24. They would run straight into machine gun fire, letting the chips fall where they may. Not that I suggest that for anyone...but how do we get from that sort of thing to thinking that we are so defenseless in our lives today and thus dependent on cops and judges to sort out all of our problems? Maybe it's just a personal preference thing, but I prefer the Wild West steez where it was more about the survival of the fittest rather than the survival of the most hiding-behind-the-system-for-protection-est.

As Ice Cube had as an intro to one of his songs...In any country, prison is where society sends it's failures. But in this country, society itself is failing.

For someone who berates others for not being able to see beyond their own region, you are incredibly blind to what is happening outside of your world. Blind or willingly ignorant.

Look beyond your own nose and talk about our generation being wimps. It doesn?t take fighting in a war to show fortitude, independent thought and rolling with the punches. Look beyond your macho Wild West fantasies and see how ?survival of the fittest? is working for child prostitutes and child soldiers, for women in the Congo and in places like Darfur, Sri Lanka and Kingston?how about disabled folks worldwide? Easy to talk about it when you?re a working, English-speaking able-bodied white man in America, isn?t it?
