Music in podcasts

I've been listening to a bunch of podcasts lately and I'm really curious about the legality of music use in them. Is it the same usage principle as radio? The difference is that people are downloading these and owning them.

There are some pretty big podcasts that use mainstream music clips. I doubt they are clearing those songs.
