This seems like it's pretty complicated since it's a cover song. Many years back my band used a sample of gangstarrs "just to get a rep". We attempted to clear said sample which actually went on to be pretty lucrative for us. They basically told us just go ahead and use it because the song is already entrenched in deep litigation from their uncleared sample of "e.v.a.".

Point is he quickly and publicly, gave Monty credit and payment.
It would have been a lot quicker and more public if he had cleared it upfront.
