  • Every legal decision in every federal court that i am aware of has found that it is illegal to....steal music. I'm surprised people needed a court to tell them that, and in fact, the only legal nuance has been related to whether it is illegal to share music, which of course, it is. b,121b,121This is hardly the RIAA's only legal win. Defendants settle because they have no case and 10k is a gift considering the actual legal penalties. b,121b,121A mistrial was granted in this case, but that doesn't mean the RIAA won't win after it gets remanded. If the article says "only win", I think the might have missed the NAPSTER case, which I believe was affirmed by the Supreme Court. They probably are referring to civil cases against individuals.

    Hate to disrupt all the girlish banter, and witttty barbs (dudes), but contingent to the original topic, major labels are outmoded. b,121b,121The idea that filesharing should be illegal seems preposterous to me. In time will probably seem like Prohibition does now. If you're a capitalist, as major labels are, then you submit to the laws of capitalism. Clearly people will not pay for what they can have for free. There was a time when music could not be had for free, but that time has passed. These major labels should cut their losses and move on to another industry, because thats what a real business does when its market dries up. They're too big? Then that's their own fault. I'm glad they put out a lot of the music that they did, but I don't feel an obligation to support a business that makes money off of artists by monopolizing lines of communication between artist and audience.b,121b,121For the sake of having a small grey area (much like the one on Faux Rillz head):b,121b,121I buy records and cds. I archive all of my music on a hard drive. I sell my record and cd collection, but I still ahve the hard drive. Is it illegal to listen to the archive?

Lucky for Kala et. al., it's ridiculously inefficient. b,121b,121Because of illegal file sharing, my record label is not economically viable. It's only because I make enough money from my real job that I can continue subsidising releasing critically acclaimed music that would otherwise be unavailable.
