b,121She stole something and you are talking like she's being wrongly accused. I hate when people try to make a defense out of being drunk and then say 'I'm harmless and white'. F*ck that.
b,121I bet she won't do that again now right?
b,121They'll try her and give her a fine probably.
b,121Stop being such a pussy and let her take responsibility for her own bad judgement, it's not that severe.

b,121I think that might have been a joke...and why do people in Europe always cry about prices when referring to American goods and services? Everything should be half-price for you when you come here considering the continued devaluation of the dollar.

b,121like it or not, in common law systems voluntary intoxication is generally considered an effective defense for crimes of specific intent (crimes where a specific state of mind is required for conviction, e.g. first degree murder- the excepetion to this are cases where the defendant gets drunk in order to give himself 'dutch courage' to commit a crime) but not to those of basic intent (crimes which can be committed recklessly or negligently, e.g. criminal damage). theft is generally considered a crime of specific intent: one must intend to permanently deprive the owner of his/her property and if she was out of her head drunk then that intention may not have formed. nevertheless, certain "borrowings" may be considered an intention to permanently deprive. if she had woken up in the morning and immediately returned the items, that would be strong evidence in her favour but from your description it sounds like she just woke up and blithely went about her day.
b,121
b,121my understanding is that the law on theft varies from state to state. The claimed value of the mannequin and dress is relevant. grand theft (usually over several hundred dollars but depending on the state) is a felony that is potentially punishable by incarceration (although highly unlikely in the case of a first time offender in the circumstances you describe). extradition for a crime of this nature is far-fetched at best but if she ever plans to go back to the US then she is going to have to face this in which case she is going to be out many thousands in legal fees.
b,121
b,121what she did was beyond stupid and she deserves to be shaken up at least a little bit. my feeling is that anyone who gets so drunk that they are committing felonies at the very least has a drinking problem.

font class="post"1b,121b,121definition from wikipedia:b,121b,121The phrase Dutch courage is a slang term for courage gained from intoxication by alcohol. It is synonymous with liquid courage.b,121b,121One theory of origin is that phrases using Dutch were created because the Netherlands used to be a rival to Britain (especially the Dutch East India Company), and generally these phrases containing "Dutch" are pejorative. A more likely source is that gin was and is a popular hard liquor in Great Britain and elsewhere, and the original/traditional source of "Holland Gin" was Holland, a region of the Netherlands
