Legal advice needed SERIOUSLY...

edited September 2005 in Strut Central
Yo I'm bugging the fuck out right now... link for story This fucking guy has been my psychologist for the last four months (yeah I got some mental issues, what), and today I opened the paper to find out he got busted for child pornography and as a plea deal he has to surrender his license to practice for 10 years. No jail time. Read the story. In my case, dude took me on as a new patient in May, the same month that his computer got taken and he was let go from his job at a pre-school. How the hell can somebody take on new patients when they're under investigation for something like that? Doesn't that go against some code of ethics or something? BAsically now, after 4 months of treatment I'm without a doctor and back to square one.I didn't even know he was a child psychologist. My boss recommended him. I showed my boss the article today, he's all shaken up, his wife is a wreck because she's a nurse and they've recommended this guy to a lot of parents whose kids have problems. My boss' pediatrician refers people to this guy all the time.I'm pissed he's not going to jail. This isn't some "oops, I clicked on some shit my bad" type thing, dude bought the shit on his credit card.Do I have any sort of legal recourse against him? Malpractice, emotional damage, breach of contract, anything like that?I feel fucking sick that I sat there and put a lot of shit on the table for this piece of shit to hear.

Jesus Sween that's awful. I can only imagine how the parents must feel.
I would take a fucking hammer to that guy's face if he ever touched my kid.
I hope everything gets straightened out for you, and hope something horrible happens to that guy.

No. He didn't commit malpractice or breach any contract with you, aside from that, even if your lawyer was able to come up with some bizarre theory of liability, you still don't have any real damages.

    Sween,

I can't give you any advice here on a legal tip but my question is: how is his being a child porn perv related to the quality of service he's rendered you as a patient? Not to sound naive in saying this but the two things can be entirely mutually exclusive. Of course, if part of his treatment regiment for you felt weird to you during the course of your meetings with him and you can connect that to what he's been busted for, then sure, you might have a malpractice suit but if the knowledge that he's a perv is what's perturbing to you, but his service was otherwise professional, I'm not sure there's a case to be had here.

Therapists are purposefully NOT supposed to bring their personal life into a patient/therapist relationship and assuming this guy managed to keep that professional distance with you, what he does in his personal life, no matter how incredibly reprehensible, would seem to fall outside of the legal standard for malpractice.

I don't get how this dude isn't going to jail though. Last I checked, child porn was some serious shit. And damn, your boss and his wife must be bugging the fuck out too.

I just hope this doesn't turn you off from the idea of therapy. I mean, this is a terrible, terrible situation, I totally feel for you.

No?? Go to www.news12.com, look in the top stories for Long Island about a psychologist from Northport. There's a video too.

I know, you're probably right. I'm just skeezed by the whole thing, and the fact that he's getting away with such a little penalty makes me want to sue the shit out of him to hit him harder.

Unfortunately at this time it does turn me off to therapy. I find something disconcerting about sitting there speaking about my problems to someone who is a bit more fucked in the head than I am.

I know man, never in a million years would I have thought that. I almost spit out my vitamins this morning when I saw it in the paper.

Now if he looked like this....

....then I'd be suspicious from the outset.

  • Me too.

You're right, Graf. Maybe a disgruntled child who was an ex-patient stole his CC # and signed him up for kiddie porn. Then, instead of trying to prove his innocence, he decided to take a plea bargain.

Are you sure you weren't trying to be funny?

No, penis(es), he was innocent while he was practicing and seeing sween. In American culture you (supposedly) can't condemn a person until they've been tried and found guilty. So therefore, the guy would've done no wrong anyway (in respect to sween) because he hadn't been found guilty yet.

    Smartasses.

  • But he pled guilty to being guilty before he was found guilty. He's retroactively guilty starting from the first admitted guilt.

So what was your point? Sween shouldn't be upset because the guy hadn't been caught while he was seeing him?

No, I was answering his question in a brief manner:

Do I have any sort of legal recourse against him? Malpractice, emotional damage, breach of contract, anything like that?

    Graf,

You really need to stop digging yourself deeper in this hole and just admit that you were .

I mean, dude plead guilty. That's the reason Sween knew about this shit to begin with.

CASE CLOSED on this "innocent 'till proven guilty" argument you're trying to push.

I can't stand people who can't admit their mistakes and then try to talk their way out of it with more b.s.

    No offense.

    What are you talking about?

Yes, I know he was found guilty... AFTER sween saw him.

So NO, you can't sue someone for going on as normal while being investigated.

AFTER, maybe. But he's innocent until then.

Why is this such a hard concept to grasp?

Not that I don't see sween's point of view and concern, that's just my 2 cents on why I don't think sween would have any recourse.
