WTF??? someone stole my record scans!

these fools here have stolen a whole slab of scans from my blog, not even giving me any credit:b,121b,121http://www.afrika70.com/#b,121b,121The idiot cheeseball behind this "movie" that never will be shot hastn't even filmed a minute's worth of footage in Africa but only interviewed a (pretty awesome) brittish collecter and presents a trailer that's a montage of stolen footage. Although for the footage, he went through the trouble of stealing from multiple sources (probably typed in "Afrobeat" at amazon.com).b,121b,121There's probably nothing I ccan do since I obviously don't own any rights to those record covers but this is really a pretty poor look.

    The whole layout and presentation of his website is pretty lame and cheap imo. He's got nothing on you. However if you were to present your movie pretty quickly you could beat him to the punch.

A clear sign that this fool has never even crossed an African border. If he actually gets some money (which I highly doubt) he's either going to run with it or waste it on a fruitless effort.b,121b,121I'm pretty sure he's not gotten any authorisation for any of the footage he used for his "teaster".

You know, just all casual like. b,121b,121The whole premise is fishy - I like how the teaser trailer is pirated footage. So he's going to somehow resurrect fela kuti and put him on a trailer across Africa? And the direct credit card donation page is out of control.

  • Frank, I hear you that this is lame and this guy should get a hefty e-smacking. Unfortunately it's not technically any more or less legal than your posting the scans. "Offense" means an action that violates a law. (I have no idea how this transfers over to Africa, either)

Now if you take a photograph of something you don't own any rights to and then someone goes and takes those pictures and uses them to solicitate money from people, pretending that those are the fruits of his own research, that's perfectly legal?b,121b,121I'm only speaking theoretically. There are much more efficient, fun and less costly ways to get back at this foll other than hiring a lawyer.b,121b,121I'm pretty sure that he can get into trouble for using those stolen and uncredited film clips.

    b,121b,121There are exceptions for copyright for academic purposes under fair use. I'm not a lawyer but maybe a case could be made on that.     b,121b,121F, copyright and fair use is a hot potato in this country. I am not a lawyer.b,121b,121From a lay perspective if you take a picture, you own the rights to it. However, if you take a picture of someone else and don't secure the rights to use their image you are open to legal action by that person. b,121b,121As for your album covers, which is sounds like you haven't secured permission to use from their respective owners, those right holders could hit you with a take down order. You could challenge that order under fair use. I would say you need to talk to a lawyer to sort this out, just get out the check book.b,121b,121Just as an aside, if you haven't already you need to put text on your site, that images are copyright of you unless otherwise stated.
