US LEGAL HELP!

i'm kind of desparate here.b,121b,121i figure some of you guys can help.b,121b,121i live in the uk and recently a female friend of mine visited Washington DC.b,121b,121she stayed in a hotel and got real drunk and decided to steal a mannequin on the way to her room (not to keep obviously - she was just drunk and silly)b,121b,121next day she went shopping and when she came back to the hotel she was arrested and has to appear in court on tuesdayb,121b,121apparently she faces real heavy fines and potential jail time for this?b,121b,121the issue being that there was a dress on the mannequin which belonged to someone at the hotel - the dress and mannequin are now back with the respective ownersb,121b,121what are the chances that a UK national would go to jail in the US for a crime of this nature??b,121b,121its so not a big deal as far as i can see.....b,121b,121over here she would probably just get a slap on the wrist......b,121b,121any help you guys can give would be greatly appreciatedb,121b,121peaceb,121b,121b

    The US legal system is all about leaving you shook the first time. Just take what they give you... which will be minimal... and leave and don't F*ck up when your on probation or if you have a record.b,121b,121Your friend will be/should be fine. Is she white?

    font class="post"1b,121b,121like it or not, in common law systems voluntary intoxication is generally considered an effective defense for crimes of specific intent (crimes where a specific state of mind is required for conviction, e.g. first degree murder- the excepetion to this are cases where the defendant gets drunk in order to give himself 'dutch courage' to commit a crime) but not to those of basic intent (crimes which can be committed recklessly or negligently, e.g. criminal damage). theft is generally considered a crime of specific intent: one must intend to permanently deprive the owner of his/her property and if she was out of her head drunk then that intention may not have formed. nevertheless, certain "borrowings" may be considered an intention to permanently deprive. if she had woken up in the morning and immediately returned the items, that would be strong evidence in her favour but from your description it sounds like she just woke up and blithely went about her day.b,121b,121my understanding is that the law on theft varies from state to state. The claimed value of the mannequin and dress is relevant. grand theft (usually over several hundred dollars but depending on the state) is a felony that is potentially punishable by incarceration (although highly unlikely in the case of a first time offender in the circumstances you describe). extradition for a crime of this nature is far-fetched at best but if she ever plans to go back to the US then she is going to have to face this in which case she is going to be out many thousands in legal fees. b,121b,121what she did was beyond stupid and she deserves to be shaken up at least a little bit. my feeling is that anyone who gets so drunk that they are committing felonies at the very least has a drinking problem.b,121b,121keep us posted on how this all turns out....
