the Supreme Court decided the case that my moot court competition held at Seton Hall was based on http://scotusblog.files.wordpress.com/2007/06/06-6407.pdfIts actually pretty interesting, the question is whether the execution of individuals who become mentally incompetant after trial is barred by the Eighth Amendment. We argued that it did not, but apparently the Supreme Court felt otherwise.The question now, that is still unanswered by the Court, is whether you can medicate the individual up to the point where he/she satisfies the competency requirement and then execute him/her.
