*EditedI just got a legal letter from the company that publishes the For Dummies books saying they want me to cease and desist with Houston For Dummies and send them a report of my profits.

Soul Strutter Mikefreedomrock works at John Wiley & Sons, Inc. . You should talk to him about helping you smooth this out.

I think a simple Cease and Decist and you will be OK. I can't imagine they would really sue you. This seems like small potatoes.

I remeber some break records from a few years back that went away because of use of the "For Dummies" theme.... I don't know who put em out

I thought DJ Fingaz put out a "DJing for dummies" break record and the artwork looked like one of the "For dummies" book. I heard he got hit with a cease order as well.

I wouldn't provide any sales figures to them whatsoever without first consulting your attorney. Not that you don't already know that.

Perhaps you can rename the CD: Houston For People Not Already Familiar With Music From Southwestern Texas??.

my lady works as a paralegal in copywright management firm - they send out these "Cease & Desist use of our trademark" letters all-day-everyday.

I would imagine that if there is a lawsuit, it would also procede at a glacial pace.

by the time it hits court, they'll be sending Cease & Desists to 'Phoenix for Dummies' or whatever city is next to blow media-wise...

I wonder if you do everything but number "three" quickly they might leave you alone. The money probably wouldn't be worth their while to go after you, they'd only pursue it on non-financial interests/to make a point.

I expect the "for dummies" gets used a lot, and so this lawyer probably sends these letters out a lot.

Anyway, coming from someone who's been in more than a few court cases in the last year, good luck and keep patience.

They have people who all they do is surf the web looking for copywrite infringement. Some hired bozo googling "For Dummies" and sending cease and desist letters. I wouldn't sweat this shit.
